A 30-person SME usually does not have an HR department. It has someone, often the founder's spouse, or an office manager who took on the role by necessity, trying to keep contracts signed, payroll running, and disputes contained. It works until it doesn't.
The mistake most Malaysian SMEs make is waiting until a crisis forces the build, a wrongful dismissal claim, a mass resignation, an EPF audit, to start building an HR function. By then, you are reacting under time pressure, usually with limited information, and the cost is higher.
A well-built HR function costs less than the first Industrial Court case it prevents. Here is the six-stage roadmap we use with growing Malaysian businesses.
Stage 1, Foundation: get the paperwork right第一阶段 · 打地基:把文件做对
Before any structural HR work, every employee must have a signed employment contract that reflects current Malaysian law. This sounds basic; it is missing or outdated in the majority of SMEs we audit.
At minimum, contracts should cover: position and reporting line, remuneration, hours, leave entitlements, probation terms, confidentiality, termination, and post-employment restrictions. Offer letters should match the contract. Contract templates should reference the 2022 Employment Act amendments.
Stage 2, Statutory compliance
Malaysian employment law has a set of non-negotiables. EPF, SOCSO, EIS contributions. Income tax (PCB) deductions. Accurate payroll records. Correct leave tracking. Proper termination procedures.
Most SMEs get 70% of this right and 30% wrong in subtle ways, wrong EPF rates for foreign workers, missed SOCSO for late starters, PCB computed on gross instead of taxable. Stage 2 is a full compliance audit against a checklist, then fixing anything that's drifted.
Stage 3, Structure: roles, JDs, and reporting lines
Once paperwork and compliance are solid, you can work on structure. This is where most founders want to start, but starting here without Stages 1 and 2 is like decorating a house with a cracked foundation.
Stage 3 deliverables: a current-state organisation chart, written job descriptions for every role, and clear reporting lines. Even a 20-person company benefits from this. It clarifies accountability, surfaces gaps, and prevents the "everybody reports to the founder" bottleneck that kills decision speed past about 40 people.
Stage 4, People processes
With structure in place, you can build the processes that actually run people day-to-day:结构到位后,才能搭建真正支撑日常人事运作的流程:
- Recruitment, how roles get approved, how candidates are sourced, who interviews, how decisions are made招聘:岗位如何审批、候选人从哪里来、谁来面试、决定怎么做
- Onboarding, what happens in the first week, first month, first 90 days
- Performance management, cadence, forms, calibration, consequences
- Compensation review, annual cycle, bonus logic, promotion criteria
- Disciplinary process, how warnings are issued, when domestic inquiries are convened, how decisions are documented
These don't need to be elaborate. They need to exist on paper, be applied consistently, and be understood by every manager.
Stage 5, Development: training and succession
Once you have a workforce being recruited and performance-managed through a defined system, you can invest in developing them. Training budgets. Leadership programmes for high-potentials. A succession plan for critical roles, at a minimum, for the founder's role and the top three operational positions.
This is also the stage where HRDC levy planning becomes useful. Most SMEs overpay levies and under-utilise claimable training. A small amount of planning unlocks significant training capacity at no additional cost.
The last stage is systems. By the time you reach this point, you know what data you need to track, what processes need automation, and what reports you need to run the business. Only now can you make an informed HRIS decision, because you are automating real processes, not theoretical ones.
Companies that buy an HRIS before Stages 1–4 usually end up with expensive software that nobody uses, because the underlying processes never existed.
How long does this take?
For a growing SME with 20–80 employees, a disciplined roll-out of Stages 1 through 5 typically takes 6 to 9 months of part-time effort from a dedicated owner, with senior HR support. Stage 6 is an additional 2–4 months depending on the scope of the system rollout.
"The best time to build an HR function was when you had 20 employees. The second-best time is now.""
A functioning HR function is not a luxury for businesses above a certain size. It is the infrastructure that lets every other part of the business run without constant founder intervention. Build it before you need it.
MICLOH's HR Consulting Retainer walks SMEs through this six-stage build as a structured engagement, typically over a 3–6 month programme. If your organisation is somewhere between "we have no HR" and "we have an HR function that works," that's exactly the gap we work in.MICLOH
